Terms and conditions

These terms and conditions apply to the use of any voucher, whether or not the voucher holder is the original purchaser. Please read these details and contact us if you need any further information or explanation. These terms and conditions are the most current of Skydive City

Contract

When you purchase a voucher or make a booking with Skydive City Pty Ltd legal obligations arise. You will be bound by these terms and conditions. You must not make a booking or purchase a voucher unless you understand and agree to these terms and conditions. You are welcome to contact us for further information about these terms and conditions.

Agency

Vouchers are sold by Skydive City Pty Ltd as agent for businesses that provide "skydiving" and recreational services to customers. Skydive City Pty Ltd is not a provider of services and has no responsibility for any services provided or not provided by any other party. Skydive City Pty Ltd makes no warranty or representation regarding the standard of any service to be provided. All Skydive City Pty Ltd vouchers are issued subject to the terms and conditions of each business and these terms. We do not have any power to control suppliers' operations. We take all reasonable precautions to ensure that the suppliers we promote are safe and reliable. However, we make no guarantees or warranties about the services that are provided to you by suppliers. Skydive City Pty Ltd acts as agent only. The suppliers provide services to customers directly.

Liability

Skydive City Pty Ltd has no liability for any act, omission or default, whether negligent or otherwise, of any service provider. Skydive City Pty Ltd has no liability for any loss or damage occasioned by any negligent act or omission of any service provider or third party. Where Skydive City's liability cannot be excluded, such liability is limited to the value of the voucher purchased.

Unlicensed/non-compliant service provider

Notwithstanding that Skydive City Pty Ltd takes all reasonable precautions to ensure that service providers are licensed and compliant, in circumstances where a service provider is not properly licensed or compliant with any applicable law, bylaw or regulation, Skydive City Pty Ltd accepts no liability (legal or equitable) for any loss suffered by you or any third party as a result.

Service descriptions

We try to ensure that our advertising information is accurate and up-to-date. However, the content or format of some services may change slightly from time to time. The company providing the service (upon confirmation of each booking) will provide final details about each service. The relevant company will notify you of any subsequent changes in writing. Your participation in each service is conditional upon your acceptance of the providing company's terms at the time your booking is confirmed.

Illustrations

The photographs used in any advertisement to illustrate multi-location services are provided to us by suppliers and are used as an indication only as the machines, vehicles, craft, animals and specific locales vary.

Venues

Skydive City Pty Ltd suppliers are located at many of Australia's best locations. We are continually adding locations but occasionally we may need to stop featuring some venues. Where locations are described as "Australia-wide," the description is indicative only. Some services may not be available in remote areas.

Session lengths

Session lengths are approximate and are given by suppliers as a guide to the total time you will be at their venue. Unless otherwise stated, you will normally take your turn with the supplier's other customers and there may be waiting time involved. Any itinerary provided to you is indicative only and the order of events may change.

Restrictions

Certain services provided by suppliers are subject to minimum age, health or other requirements. These details are featured in the gift pack information. Please read this information carefully once you have received it and notify us within seven days if any service is unsuitable. Once you have confirmed a booking you may be liable for supplier and/or agency charges if you are forced to cancel because the minimum requirements are not met. Details of each supplier's requirements are set out on the Skydive City Pty Ltd website under each service. Please read them carefully.

Validity of vouchers and exchange

Vouchers for specific services and Gift Vouchers must be used within 6 months of purchase. These expiry dates cannot be extended and expired vouchers are non refundable in whole or in part. Vouchers for specific services may be exchanged (while valid) for another service once only. An administration fee of $20 per voucher will apply, plus any additional amount if the chosen service is more expensive than the original service. If the chosen service is less than the amount originally paid, the balance will be held in credit for 6 months for you to use against any future purchase. The expiry date of any replacement voucher remains the same date as the original voucher. Vouchers are not redeemable for cash and are not refundable. Exchanges are not permitted after a voucher has been redeemed by contacting Skydive City Pty Ltd. The onus is on the holder of a voucher to use it prior to its expiry date.

Prices

We reserve our right to change prices without notice. All prices include Goods and Services Tax (GST) at the current rate of 10%.

Availability

All services are offered by suppliers subject to availability. Bookings should be made at least 3 weeks in advance. If you would like to book during peak times (such as weekends or holidays), you should book further in advance. Bookings are not finalized until you have received confirmation to that effect from Skydive City.

Cancellation

Once your booking has been made, you may incur agency and supplier fees if you cancel. Sometimes you may lose your voucher completely if the supplier is unable to fill your space on the day. If a supplier needs to cancel a service for any reason, you will be notified as soon as possible in order to set a convenient alternative date for the service.

The weather

Obviously many of the services offered by suppliers are weather dependent. You will have the supplier's details so you can check if services are affected by bad weather on the day of your booking. If bad weather affects a booking it will be re-booked at no cost to you.

On the day

If you have a problem or a complaint on the day of service, please bring it to the supplier's attention at your earliest opportunity on the same day.

Voucher delivery service

Skydive City Pty Ltd vouchers are delivered by Australia Post express post services. We are not liable for any loss suffered as a result of a voucher being lost in the normal express post mail process. A courier service is available for deliveries to specified addresses in metropolitan areas of major cities. (Courier deliveries outside these areas may be arranged but are subject to an additional charge and special conditions.)

Insurance

The very nature of some of the services that we promote as agent means that they are dangerous. Prior to ordering or participating in any service you should be aware of this fact. Skydive City Pty Ltd can provide further information if you are in any doubt about any service. We require our service providers to hold appropriate and valid public liability insurance before we will promote their services as agent; however we make no warranty or representation about their services whatsoever. Responsibility rests with you to make independent enquiries with the supplier and other third parties as to the need to acquire your own insurance cover.

The text and illustrations (including photographs) used by Skydive City Pty Ltd are protected by copyright and must not be copied in whole or in part with the express permission of Skydive City.
